The relevant agreement must include a statement of the skill, trade or occupation which the apprentice is being trained for. By comparison, the National Minimum Wage increased by less than CPI between April 2021 and April 2023. The CPI measure of inflation rose by 17.4% between September 2021 and September 2023. Over the same period the Real Living Wage for the UK went up by 21.2% (19% in London). The charity says more than 460,000 employees working for 14,000 firms currently receive the Real Living Wage.
- The assessment day takes place in a kitchen and involves all applicants cooking a range of dishes to be tried by the interviewing panel.
- Employers often require workers to wear specific uniforms, work wear or items of clothing in connection to the job – a dress code.
- Employers covered by the FLSA but who are not subject to the Puerto Rico Minimum Wage Act must pay at least the federal minimum wage of $7.25 per hour.
- The U.S. Department of Labor enforces the Fair Labor Standards Act (FLSA), which sets basic minimum wage and overtime pay standards.
- If a worker chooses to pay for the purchase via a payment from the worker to the employer (that is, the worker pays for the goods after they have been paid their wages), the payment will not reduce pay for minimum wage purposes.
However, if the individual is carrying out work for you, often called ‘on the job training’, they will fall within the definition of a worker. If the trainee is a worker, they must be paid the correct minimum wage rate for all hours worked. Like the term ‘intern’, the term ‘trainee’ is not defined in national minimum wage legislation. It is a commonly used term by employers and training providers but has no bearing on whether or not someone is minimum wages a worker for minimum wage purposes. However, workers on the legal pay floor will still be left £1,092 a year short of the voluntary “real living wage” set by the Living Wage Foundation charity, which is paid by thousands of employers to reflect household costs. The fast-food workers’ minimum-pay bump was approved last year along with another law that will raise the minimum wage for all health care workers in California to $25 an hour by 2029.
BrewDog faces staff backlash after dropping real living wage pledge
Additionally, if the individual is a participant in a genuine traineeship programme – operated in England – they do not qualify for the national minimum wage. She is told that for 3 months she will be reimbursed ‘expenses only’ and is referred to as an ‘unpaid intern’. However, as part of her agreement with the company, it is promised that at the end of her ‘internship’ she will be taken ‘on the books’ and paid above the minimum wage. The promise of paid work means it is likely that Amanda should be paid at least the minimum wage for the whole time she spends at the record company.
All agricultural workers must be paid at least national minimum wage rates unless they are covered by higher agricultural minimum wage rates. Only the amount of the adjusted deduction or payment which exceeds the accommodation offset will reduce the worker’s minimum wage pay. If a worker is required (whether contractually or by any other imposed requirement by you) to make a payment related to transport, this will reduce the worker’s pay for minimum wage purposes. If you have contracted the third party to provide transport for workers – then the liability is yours and any deductions will be for your own use and benefit. This will lead to the amount reducing the workers’ pay for minimum wage purposes.

From Monday that will go up by 1.02 pounds ($1.29) to 11.44 pounds ($14.44) as a new United Kingdom minimum wage kicks in. The law applies to restaurants offering limited or no table service and which are part of a national chain with at least 60 establishments nationwide. Restaurants operating inside a grocery establishment are exempt, as are restaurants producing and selling bread as a stand-alone menu item. The law was supported by the trade association representing fast food franchise owners. But since it passed, many franchise owners have bemoaned the impact the law is having on them, especially during California’s slowing economy.
While the new legal minimum wage, also known as the National Living Wage (NLW), represents a 9.8 percent increase from previous levels – the highest single boost since 2001 – it is still insufficient for Subramanian. The previous minimum wage in California, regardless of industry, was $16 an hour — meaning many cashiers, line and prep cooks, counter attendants and baristas will see as much as a 25% raise overnight. California’s current overall minimum wage, which increased to $16 from $15.50 on Jan. 1, already exceeded that in most other states — only Washington State’s and the District of Columbia’s are higher. Californians will vote in November on whether to push it up more, to $18 an hour. Read Kurtis’s full article on how the law is affecting workers and employers.

Deductions or unreimbursed payments made by a worker for any Personal Protective Equipment, or any other required equipment, will reduce the worker’s pay for minimum wage purposes. A worker’s pay for minimum wage purposes must be calculated in a particular way. Wrongly including an element of pay that doesn’t count – for example an extra premium for overtime – can result in it appearing that the minimum wage is being paid when in fact it is not. Where payment is not made in the period in which it is earned, you will not be able to calculate the worker’s minimum wage rate for the original pay reference period until the end of the next pay reference period. Each case would be dealt with based on its individual facts and consideration would be given to whether the level of payment was for subsistence or to provide an income on top.
Even though Eileen works for a charity, the voluntary worker exemption does not apply to Eileen because she is in receipt of training in excess of that allowed by the exemption. She has a contract in which she has agreed to organise certain events for the charity and attend on particular days and times. She is not paid, but reasonable travel and lunch expenses are paid back. She does not need to be paid the minimum wage because she is a voluntary worker. If any payment or remuneration is made for work done, the intern is likely to be regarded as a worker for minimum wage purposes.
